At a Court held for the County of Southampton on 10th day of September 1795 This Will was presented in Court by Joseph Bentel & Jesse Cotton the Exors therein named & proved by the oaths of Jacob Turner & Etheldred Turner two of the witnesses thereto & ordered to be recorded. And on the motion of the said exors who made oath according to law a certificate is granted him for obtaining a probat thereof in due form giving security whereupon &c Sam Kello ========================================================================================== In the left margin: J Thorp's Will In the Name of God Amen I John Thorp of Southampton County State of Virginia being weak of body but of sound mind & memory do make & ordain this my Last Will & Testament as followeth. To Wit Imprimis: I lend to my loving wife Polly Thorp (during her natural life or widowhood) the use of all my land & plantation whereon I now live, also the use of my part of the still left me by my father, also the use of my two negros to wit Mark & Joan, two Iron potts, half dozen pewter plates, six earthern plates two pewter dishes, three pewter basons, one frying pan each to her choice - one iron skillet, two water pails, three wash tubs to her choice, one spinning wheel to her choice, three pair of cotton cards to her choice, three feather beds & furniture, one sorel mare called the old Mare, one sorrel colt call'd Fagan, two calves & calves, Four ewes & lambs, call the hogs belonging to the gang living on the beaver pond by Charles basses, 50 pounds of corn cart & wheel, one loom. And after her death or marriage of said wife my will & desire is that what I have lent to my wife, except the land, to be sold to the highest bidder & the money rising from said sale to be equally divided between all my children hereafter named to wit Aaron, Elizabeth, Reese, Susannah, Moses, John, Polly, & the child my Wife is now pregnant with & after the death of marriage of my Wife my will & desire is is that the land I have lent my wife be rented out (for the Benefit of all my sons above named also the child unborn if it is a son) till my youngest son arrives to the age of twenty one years And then the said land to be sold & the money to be equally divided between all my above named & mentioned sons including the child unborn if is a son. Item, My will & desire is that the remainder of my state of what nature or kind soever found (including the land a bought of Charles Bass) And wheresoever found, Except my Legacy due me by John Reese's Will be sold to the best Bidder. And the money rising from sᵈ sale be applied to discharge my just debts & the balance if any be divided between my before mention children equally. Item, My will & desire is that the money which may be due me by the will of John Reese decd as my Wife's legacy be applied by my executor hereafter named & he is hereby authorized to purchase a negro man slave to be considered as part of my estate & that my sᵈ Wife had the sole use of sᵈ Negro to benefit during her life or widowhood & after her death or marriage to be sold & the money to be equally divided between all my above mentioned children Lastly I constitute an appoint my friends John Harris Senr Randolph Reese Rivers Reese & Roger Reese my whole & sole Exors of this my Last Will & Testament revoking all other Wills or Wills by me heretofore made In Witness whereof I have hereunto Set my hand & affixed my seal this seventh day of July 179 five Signed Sealed & Delivered to be the Will & testament of the testator in the presence of John Thorp (seal) John Williamson Nathaniel Smith Rowell Reese At a Court held for the County of Southampton on 10th day of September 1795 This Will was proved by the oaths of Nathaniel Smith & Rowell Reese two of the Witnesses thereto % ordered to be recorded.
